GENERAL CONDITIONS OF USE.
OBJECT
The present General Conditions govern the use (including mere access) of the web pages that form part of the Qvadrigas Abogados website, including the contents and services provided in the said site (the "QV Site"). Any person who accesses the QV Site ("User") accepts the General Conditions that are in force at the moment they access the said Site. The contents and services that Qvadrigas Abogados place at the disposal of Users in the QV Site (respectively, "Contents" and "Services") may also be regulated by specific conditions ("Specific Conditions") that will prevail over the General Conditions in the event of any conflict. Users are also subject, each time they use the relevant Contents or Service, to the applicable Specific Conditions.
Consequently, Users should carefully read the General Conditions each time they intend to visit the QV Site and, if relevant, the applicable Specific Conditions each time they intend to use the Contents or Services provided.
In any case, Qvadrigas Abogados reserves the right to change, at any time and without prior notification, the presentation and configuration of the QV Site, the present General Conditions or the relevant Specific Conditions.
USE OF THE QV SITE
The QV Site is not a source of advice or a means of establishing a professional or any other type of client-lawyer relation
· Use
Unless otherwise stated in the Specific Conditions, use of the
QV Site will be free, not affecting the cost of connecting via
the relevant telecommunications network to which Users have access.
Users are fully aware and they voluntarily and expressly accept
that they use the QV Site under their sole and exclusive responsibility.
By using the QV Site, Users enter into a commitment not to act
in any way that may damage the image, interests and rights of
Qvadrigas Abogados or of third parties, or that may damage, render
useless or overload the QV Site, or that may prevent, in any
way, the normal use of the QV Site.
Qvadrigas Abogados adopts reasonable safety measures to detect
the existence of viruses. However, Users must be aware that Internet
computer system safety measures are not totally reliable and
that, therefore, Qvadrigas Abogados is unable to guarantee the
non-existence of viruses or of other elements that may affect
Users' computer systems (software and hardware) or their electronic
documents and files stored in the said systems.
· Contents
The Contents in the QV Site are placed at the disposal of Users
by Qvadrigas Abogados and include information from own sources
and from third parties. Qvadrigas Abogados endeavours to ensure
that the contents are of the highest possible quality and are
reasonably updated. However, Qvadrigas Abogados does not guarantee
the use, accuracy, exhaustive nature, relevance and/or updating
of the Contents. The incorporation of Contents to the QV Site
does not, in any way, imply the provision of any type of legal
consultancy service.
Users accept that, as the application of law to specific cases
is not automatic but can vary depending on highly diverse circumstances,
the information included in the Contents is insufficient to make
decisions of any nature. Consequently, the information included
in the Contents cannot be considered as an alternative to legal
advice and Qvadrigas Abogados advises Users against making decisions
based on the information included in the Contents without obtaining
appropriate professional guidance.
· Intellectual and industrial property rights
Based on the contents of these General Conditions, no intellectual or industrial rights are ceded in relation to the QV Site or to any elements that integrate it. Users are expressly forbidden from copying, changing, distributing, publicly communicating, placing at the disposal of others, extracting, re-using, forwarding or using the said information in any way or using any means except when legally permitted, i.e., when authorised by the holder of the said rights.
Users may view and obtain a temporary private copy of the Contents for their own personal and private use on their computer systems (software and hardware), if and when there is no intention to participate in commercial or professional activities.
Users should abstained from obtaining, or from trying to obtain, the Contents by means or procedures other than those placed at their disposal at each moment or indicated or that are usually used on Internet (if the latter do not imply any risk of damaging or rendering the QV Site useless).
Users must respect all intellectual and industrial property rights at all times in relation to the QV Site, owned by Qvadrigas Abogados or third parties.
· Hyperlinks and Linked Sites
a) Hyperlinks:
Users and, in general, any individual or legal entity that intends
to establish a hyperlink or technical linking device (for example,
links or buttons) from their web site to the QV Site (the "Hyperlink")
must obtain prior written authorisation from Qvadrigas Abogados.
The integration of a Hyperlink does not, in any case, imply
the existence of any relation between Qvadrigas Abogados and
the owner of the site or web page where the Hyperlink has been
implemented, nor the acceptance or approval by Qvadrigas Abogados
of its contents or services.
In any case, Qvadrigas Abogados reserves the right to forbid
or render useless any hyperlink to the QV Site at any time, especially
if the activities or contents of the web site that has implemented
the hyperlink are of an allegedly illegal nature.
b) Linked Sites:
The QV Site provides Users, only for purposes related to searching and accessing information, contents and services available on Internet, with hyperlinks or technical linking devices (for example, links or buttons) that enable Users to access Internet sites or portals belonging to or managed by third parties ("Linked Sites").
Qvadrigas Abogados does not offer or market by itself or through third parties the information, contents and services available on Linked Sites, nor does it approve, supervise or control, in any way, the contents and services and any other material of any nature that may exist on the said sites. Users assume full and exclusive responsibility for browsing through the said sites.
PERSONAL DATA
By simply visiting the QV Site, no data of a personal nature
that may identify a User will be automatically registered. However,
certain information of a non-personal nature and that cannot
be linked to a specific User is collected and registered on Qvadrigas
Abogados' Internet Servers (for example, the type of Users' Internet
browser, operating system, IP address used to access QV Site
web pages) with a view to improving Users' browsing experience
and managing the QV Site.
Nevertheless, the use of certain Contents or Services may require
the provision of certain User data of a personal nature. Qvadrigas
Abogados will provide Users with the necessary information in
advance so that they may grant their consent for Qvadrigas Abogados
to process their personal data and include them in the relevant
files owned by Qvadrigas Abogados.
APPLICABLE LAW AND JURISDICTION
These General Conditions are governed by Spanish Law.
